These Terms of Service govern the use of Prisma Grading Company services, website access, certification lookup, submission handling, grading activity, and any related communications. By using this website or submitting cards to Prisma Grading Company, you agree to be bound by these Terms.
1. Company and Scope
Prisma Grading Company provides grading, encapsulation, certification, record archiving, and related collector services for trading cards and other eligible collectibles. Service availability may vary by product type, declared value, operational capacity, and internal intake policy.
2. Eligibility and Submissions
By submitting any item, you confirm that you are the lawful owner of the submitted property or are authorized to act on behalf of the owner. You are responsible for the accuracy of all submission information, including declared value, card identity, set information, and shipping details.
3. Grading Determinations
All grading results, subgrades, labels, qualifiers, service classifications, and final determinations are made solely by Prisma Grading Company according to its internal grading standards. Grading is inherently opinion-based. While Prisma aims for consistency and internal quality control, all grading conclusions remain final once issued, except where Prisma independently determines that an administrative correction is appropriate.
4. Authentication and Suitability
Prisma reserves the right to refuse, return ungraded, or otherwise decline any submitted item where authenticity, condition, alteration, restoration, damage, or submission suitability cannot be reasonably addressed under available service procedures.
5. Fees and Payment
All service fees, surcharges, return shipping fees, insurance charges, handling costs, and any applicable taxes must be paid in full before return release of graded items. Prisma reserves the right to adjust submitted service levels if the declared value or handling category is determined to be inaccurate.
6. Declared Value
Declared value is the customer’s stated estimate of an item’s market value after grading and is used for service level assignment, insurance handling, and shipping administration. Prisma may require service level correction if a declared value appears materially inaccurate.
7. Turnaround Times
Any turnaround times published on the website are estimates only and are not guaranteed. Processing times may vary due to submission volume, staffing, operational review, holidays, customs procedures, quality control requirements, or events outside Prisma’s reasonable control.
8. Shipping and Risk Transfer
Customers are responsible for securely packaging items prior to shipment to Prisma. Risk of loss in transit to Prisma remains with the sender until delivery is confirmed at Prisma’s intake location. Risk of loss for return shipment is governed by the applicable shipping and insurance terms published by Prisma.
9. Liability Limitation
To the maximum extent permitted by applicable law, Prisma Grading Company shall not be liable for indirect, incidental, special, punitive, or consequential damages, including loss of market opportunity, speculative value loss, emotional distress, or collector premium expectations. Prisma’s aggregate liability for a submitted item shall not exceed the lower of:
- the customer’s declared value accepted for service purposes, or
- the amount recoverable under the applicable shipping or insurance policy actually in effect.
10. Slab, Label, and Certification Records
Certification records may include population data, grade presentation, archived slab scans, and digital lookup content. Prisma reserves the right to update the format, display, structure, or availability of record information without prior notice. Certification data remains the property of Prisma except where disclosure is required by law.
11. Customer Conduct
You agree not to misuse the website, attempt to scrape restricted certification data, interfere with normal site operation, impersonate others, submit fraudulent information, or use Prisma records in a misleading or deceptive commercial context.
12. Suspension and Refusal of Service
Prisma reserves the right to suspend, limit, or refuse service where conduct, submission pattern, payment history, fraud risk, abuse, shipping irregularity, or legal compliance concerns justify such action.
13. Intellectual Property
The Prisma name, logo, labels, visual layouts, website content, certification formats, and proprietary service presentation are protected by applicable intellectual property laws and may not be copied, reproduced, or used without authorization.
14. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws applicable to Prisma Grading Company’s place of establishment, unless mandatory consumer protection law requires otherwise.
15. Changes to These Terms
Prisma may update these Terms of Service from time to time. The current version published on the website shall control future use of the services from the effective date shown above.
